Terms of service
Effective: June 2026
These terms govern the use of phoner.ai and the Phoner service. By creating an account or using a Phoner number you accept them.
1. The service
Phoner provides a cloud business phone system: local and toll-free numbers, calling over the internet, IVR phone menus, team routing, voicemail transcription, business texting, and call recording with consent tools, used from mobile, desktop, and web apps. We may improve or change features; where a change materially reduces what you pay for, we will tell you in advance.
2. Accounts
You must provide a real email address and keep your access credentials confidential. You are responsible for activity under your account and for your team's use of the service. We may suspend accounts that breach these terms or put the service, phone networks, or other customers at risk.
3. Lawful use and recording consent
Call recording and consent laws vary by state and country. Phoner gives you consent tools (announcements, per-line recording toggles), but you are responsible for lawful use and for getting consent where required.
The same principle applies to the rest of the service: you are responsible for using calling and texting lawfully, including telemarketing, robocall, and anti-spam rules such as the TCPA. Nothing on this site is legal advice; where recording or outreach rules matter to your business, ask a lawyer.
4. Acceptable use
- No unlawful, fraudulent, or harassing calls or messages, and no spam.
- No caller-ID spoofing or misrepresenting who is calling.
- No attempts to breach, probe, or overload the service or the networks it connects to.
- No reselling of the service without a written agreement with us.
5. Emergency calling (911)
VoIP 911 differs from traditional landline 911, and you must understand the difference before relying on Phoner for emergencies:
- 911 calls are routed based on the service address you register with us, not your device's physical location. You must register a service address and update it every time you move or take the service somewhere new.
- Emergency calls may not work during a power or internet outage, or if your device has no data connection.
- Keep a mobile phone or other means of calling emergency services available as a backup.
By using the service you acknowledge these limitations and agree to inform everyone who uses your Phoner lines about them.
6. Billing
Plans are priced per user and billed monthly or yearly in USD at the prices published on the pricing page; yearly billing is discounted. There is no long-term contract: you can add or remove users any month and cancel at any time, with the subscription running to the end of the paid period. We do not refund partial periods except where the law requires. Prices can change with at least 30 days notice, taking effect at your next renewal. Add-ons (extra and vanity numbers) are billed per number per month; number porting is free.
7. Your numbers and your data
Numbers assigned to your account remain yours to use while your account is active, and you can port them out at any time. You own your call data: recordings, voicemails, transcripts, texts, and logs. We process that content only to provide the service, as described in the privacy policy.
8. Termination
You may cancel and delete your account at any time. We may terminate with 30 days notice, or immediately for material breach, non-payment, or use that endangers the service or phone networks. On termination you have 30 days to port out your numbers and export your data, after which data is deleted per the privacy policy.
9. Warranties and liability
The service is provided "as is" without warranties of fitness for a particular purpose. We do not publish an availability figure for the service and do not offer a contractual uptime SLA; internet calling depends on networks we do not control. To the extent the law allows, our total liability for any claim is limited to the fees you paid in the 12 months before the event giving rise to the claim, and we are not liable for indirect or consequential damages, lost profits, or the consequences of unlawful recording or emergency-calling limitations described above.
10. Governing law and changes
These terms are governed by the laws of the operator's registered jurisdiction, without prejudice to mandatory consumer protections. If we change these terms materially we will notify account holders at least 14 days before the change takes effect.
